Why Justice Roberts is right? Or was He? - July 4th, 2012, 09:30 PM

Article I

Section 7 - Revenue Bills,

All bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

According to Chief Justice Roberts the mandate is a tax applied as a penalty for not purchasing health care Insurance. The Health care bill is a revenue bill if it is anything now. The House of Representatives did not originate this bill. If it is a revenue bill now, it was a revenue bill when it was passed. Therefore it is unconstitutional legislation.

The court was not ruling on the constitutionality of the tax but the
constitutionality of the mandate under the commerce clause. The tax cannot be challenged until someone actually pays the tax then the person who has paid the tax has standing to chalenge the legality of the tax.

As mad as I was at Chief Justice Roberts I must give him his due and admit that he was right on this issue. He has not turned liberal but has ruled correctly according to the Constitution.
